1. Acceptance of Terms

By accessing or using Brand Builder ("the Platform"), operated at brandbuilder.net, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Platform. Continued use of the Platform following any updates to these terms constitutes acceptance of those changes.

2. Description of Service

Brand Builder is an AI-powered branding platform that helps businesses develop their brand identity. The Platform uses artificial intelligence to generate brand voice guidelines, content samples, and a trained brand bot, delivered through a guided onboarding process and ongoing subscription dashboard.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You must notify us immediately of any unauthorized use of your account.

4. Payment Terms

The Platform operates on the following pricing structure:

• One-time setup fee: $497, covering onboarding, brand voice development, and initial content generation.
• Monthly subscription: $99/month, providing continued access to your brand bot, dashboard, and content generation credits.

All payments are processed through Stripe. You authorize us to charge the payment method on file for all applicable fees. Subscription fees are billed monthly in advance and are non-refundable except as required by law. We reserve the right to change pricing with 30 days' written notice.

5. Intellectual Property

Your content: You retain full ownership of all brand output generated through the Platform, including brand voice guidelines, content samples, and any materials produced by your brand bot.

Our platform: Brand Builder retains all rights, title, and interest in the Platform itself, including its design, code, AI models, proprietary prompts, and underlying technology. You may not reproduce, reverse-engineer, or redistribute any part of the Platform.

6. Acceptable Use

You agree not to:

• Use the Platform for any unlawful purpose
• Generate content that is hateful, defamatory, or infringes on the rights of others
• Attempt to gain unauthorized access to the Platform or its systems
• Resell, sublicense, or redistribute Platform access without written consent
• Interfere with or disrupt the integrity or performance of the Platform

7. Limitation of Liability

To the maximum extent permitted by law, Brand Builder and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses arising out of your use of the Platform. Our total liability shall not exceed the amount you paid to us in the twelve months preceding the claim.

8. Termination

You may cancel your subscription at any time through your account dashboard. We reserve the right to suspend or terminate your account if you violate these terms. Upon termination, your access to the Platform will cease, but you will retain ownership of any brand output previously generated. We may retain anonymized, aggregated data for analytics purposes.
